Improving lease terms on renewal – what are the courts doing now?
Recorded on: 27/10/2023
The Landlord and Tenant Act 1954 entitles the tenant to a new tenancy, but what terms should it contain? Do the parties simply begin with a blank sheet of paper? The Act gives only limited guidance on the terms the court should determine for the new lease, and much more of the applicable law derives from decided cases. It’s vital to be familiar with them, as what the court might do will naturally determine the ground rules for the parties’ negotiations. Knowledge is power, in lease renewal negotiations.
The webinar will include:
- How does the court resolve issues over the length of term? How does the latest caselaw alter the position?
- Assessment of the new rent, and determination of rent review terms
- The O’May principle, and the scope of “reasonable updating”
- Key commercial terms: break options, service charge, use restrictions
- Response to current issues – Covid-19 and climate change
