Going to trial is always expensive and fraught with risk. To see off an opponent prior to trial is a beguiling proposition but how and when can it be done? Recent Court of Appeal authorities have taken a wide-ranging view as to what might amount to abuse of process, and protocols are more important now than ever before. The latter have become big since the Court of Appeal’s 2019 ruling in Jet 2, where individuals who made false statements in witness statements provided in purported compliance with a pre-action protocol could face committal for contempt of court.
